When should you appeal a GST order?
Not every adverse order needs an appeal. Some are better corrected through rectification, and some contain a demand that is genuinely payable. Before filing, we read the order with your original notice and reply, and tell you plainly where you stand on each issue.
You should consider an appeal when:
- The order confirms a demand that your reply had answered with evidence.
- The order invokes fraud or suppression without any facts to support it.
- A personal hearing was not given, or your submissions were not considered.
- The demand is time-barred, or the notice was issued beyond the period allowed.
- Your registration has been cancelled and revocation is no longer available.
The GST appeal route
| Stage | Authority | Form | Time limit | Pre-deposit |
|---|---|---|---|---|
| First appeal | Appellate Authority (Section 107) | APL-01 | 3 months from communication of the order, plus 1 month on sufficient cause | Admitted amount in full, plus 10% of disputed tax (maximum Rs 20 crore each under CGST and SGST) |
| Second appeal | GST Appellate Tribunal (Section 112) | APL-05 | 3 months from communication of the appeal order, or any later notified date | A further 10% of the tax remaining in dispute (maximum Rs 20 crore each under CGST and SGST) |
| Further appeal | High Court (Section 117) | As per court rules | 180 days, on a substantial question of law | As directed |
| Further appeal | Supreme Court (Section 118) | As per court rules | As per court rules | As directed |
For appeals against penalty-only orders, a pre-deposit of 10% of the penalty applies at both appellate stages under the amendments made by the Finance Act, 2025. Where a case challenges the validity of a provision or a gross violation of natural justice, a writ petition before the High Court may also be considered.
Filing a first appeal under Section 107
- Order review. We read the order, the notice, your reply and the hearing record, and list the issues on which the order is weak.
- Pre-deposit working. We calculate the admitted amount and the 10% of disputed tax, take credit for any DRC-03 payments already made, and tell you the exact cash required.
- Grounds of appeal. Each ground is drafted separately, covering the facts, the law, the relevant circulars and decided cases where they help.
- Statement of facts and documents. The appeal is supported by a clear statement of facts and an indexed set of documents.
- Online filing. The appeal is filed in APL-01 on the GST portal, and the acknowledgement in APL-02 is issued as prescribed in Rule 108.
- Hearings. We attend the hearings, file written submissions and respond to any remand report sought from the original officer.
- Order in appeal. The appeal order is issued in APL-04. If it is not in your favour, we review it for the Tribunal.
The GST Appellate Tribunal (GSTAT) in 2026
For years, second appeals were stuck because the Tribunal had not been constituted. That has changed. The GST Appellate Tribunal was formally launched in September 2025 with online filing, and hearings began in early 2026 before the Principal Bench in New Delhi and State Benches.
Points to note:
- Online filing. Appeals are filed electronically on the Tribunal’s e-filing portal, with the appeal order, grounds and documents.
- Backlog appeals. For older orders that could not be appealed earlier, the government notified special last dates. The latest notification fixed 31 July 2026 for appeals against orders communicated before 1 May 2026. For orders communicated after that, the normal three-month period applies.
- Principal Bench jurisdiction. Appeals involving place of supply issues are heard by the Principal Bench.
- Cross-objections. The department can file cross-objections, and your representative must be ready to answer them.
If you missed the backlog deadline, do not assume the matter is closed. We review whether condonation of delay can be sought on sufficient cause.
Rectification under Section 161
Many orders contain mistakes that do not need an appeal: tax counted twice, a DRC-03 payment ignored, an arithmetical error, or a demand for a period that the notice did not cover. Section 161 allows such errors apparent on the face of the record to be rectified by the officer, on an application or on their own.
We file rectification where the error is clear, and in parallel keep track of the appeal period. Rectification does not stop the appeal clock, so where the stakes are high we file the appeal within time as well.
Case management for GST litigation
Litigation often runs over several years and several officers. Missing one hearing or one deadline can undo good work. For every case we handle, we maintain:
- A case diary with the notice, reply, order, appeal and every hearing date.
- A deadline list covering reply dates, appeal dates and pre-deposit dates.
- A record of every payment made through DRC-03 and its link to the demand.
- Copies of every submission and acknowledgement, shared with you on WhatsApp or email.
For businesses with several open matters across years or states, we give a single status sheet so you always know what is pending.
Common mistakes in GST appeals
- Filing the appeal after the time limit, without a proper application for condonation of delay.
- Paying the pre-deposit through the credit ledger or not linking it to the order.
- Grounds that only say “the order is bad in law” without addressing each finding.
- Raising new facts at appeal that were never placed before the original officer.
- Waiting for a rectification decision while the appeal period runs out.

Frequently asked questions
What is the time limit for filing a GST appeal?
An appeal to the Appellate Authority under Section 107 must be filed within three months from the date the order is communicated to you. The Appellate Authority may allow a further one month if you show sufficient cause for the delay. An appeal to the GST Appellate Tribunal under Section 112 must be filed within three months from the communication of the appeal order, subject to any later date notified by the government.
How much pre-deposit is required for a first appeal?
You must pay the full amount of tax, interest, fine, fee and penalty that you admit, plus 10% of the remaining tax in dispute, subject to a maximum of Rs 20 crore each under CGST and SGST. Where the appeal is only against a penalty without any tax demand, a pre-deposit of 10% of the penalty applies under the amendment made by the Finance Act, 2025.
Does filing an appeal stop recovery?
Yes. Once the pre-deposit is paid and the appeal is filed, recovery of the balance amount is deemed to be stayed until the appeal is decided, under Section 107(7). A similar stay applies before the Tribunal under Section 112(9) after the further pre-deposit is made.
Is the GST Appellate Tribunal working now?
Yes. The GST Appellate Tribunal was formally launched in September 2025, appeals are being filed online, and the Principal Bench in New Delhi and State Benches have been hearing cases during 2026. The government also notified special last dates for filing older backlog appeals, the latest of which was 31 July 2026.
Can I pay the pre-deposit using input tax credit?
The pre-deposit should be paid in cash through the electronic cash ledger. Amounts you have already paid against the demand through DRC-03 can be adjusted against the pre-deposit by following the procedure on the portal.
What if the order has a clear mistake?
If the mistake is apparent on the face of the record, such as a calculation error, double counting or a payment not considered, a rectification application under Section 161 is often quicker than an appeal. It must be filed within the time allowed under that section, and you should not let the appeal period lapse while waiting for rectification.
Can new documents be submitted at the appeal stage?
Generally, additional evidence is allowed only in the situations listed in Rule 112, such as where the officer refused to admit evidence or you were prevented by sufficient cause from producing it. This is why it matters that your reply at the notice stage is complete.
Appeal file karne ke baad kitna time lagta hai?
It depends on the authority and its workload. Section 107(13) asks the Appellate Authority to decide an appeal within one year where possible. Tribunal timelines depend on the bench's listing. We keep you updated after every hearing.
