The Haryana position after the 2025 amendment
Haryana adopted the Punjab Shops and Commercial Establishments Act, 1958, and now refers to it as the Haryana Shops and Commercial Establishments Act, 1958. The Haryana Shops and Commercial Establishments (Amendment) Act, 2025, notified in February 2026 and deemed effective from 12 November 2025, changed how establishments in Gurugram deal with the Labour Department.
| Point | Position after the 2025 amendment |
|---|---|
| Establishments with 20 or more workers | Online registration within one month of commencing business |
| Establishments with fewer than 20 workers | Online intimation only; a Basic Information Performa (BIP) ID is generated |
| Renewal | Not required; registration continues until cancelled |
| Change in particulars | To be reported within 7 days |
| Closure | To be notified within 30 days |
| Daily working hours | Up to 10 hours, subject to the weekly limit |
| Overtime | Up to 156 hours per quarter, paid at twice the ordinary rate |
| Appointment letters and ID cards | Required for employees, with prescribed particulars |
Interaction with the OSH Code
The Occupational Safety, Health and Working Conditions Code, 2020 came into force on 21 November 2025. In May 2026 the Haryana Labour Department notified that establishments registered under Section 3 of the OSH Code, once the Haryana rules are finalised, will not need separate registration or intimation under the Shops Act. Until that framework is fully in place, we file under the Shops Act and review your position whenever the state rules change.
Who is covered
The Act applies to shops and commercial establishments in the notified areas of Haryana, which include Gurugram. In practice this covers:
- Retail shops, showrooms and stores in markets and malls.
- Offices of companies, LLPs, firms and professionals.
- Restaurants, cafes, bakeries and cloud kitchens.
- Salons, gyms, coaching centres and clinics run as commercial establishments.
- Warehouses and godowns linked to trade.
Factories covered by labour laws for factories are dealt with separately. See our factory licence service.

Registration process, step by step
- Worker count and coverage. We confirm the number of workers, including those engaged through contractors where counted, and whether you need registration or intimation.
- Portal login. The application is made online on the Haryana Labour Department portal using the employer’s details.
- Application or intimation. Business name, address with GPS location, nature of business, employer details and worker count are entered and documents uploaded.
- Certificate or BIP ID. For 20 or more workers, the Inspector verifies and issues the registration certificate online within the time set under the Haryana Right to Service Act. Smaller establishments receive the BIP ID on intimation.
- Handover. We share the certificate or intimation on WhatsApp with a short note on display, records and working-hour rules.
Using the certificate: bank accounts, GST and loans
The shop and establishment certificate or intimation is commonly used as:
- One of two business proofs for a proprietorship current account.
- Supporting address proof for GST registration and FSSAI registration.
- Business vintage evidence for MSME and working capital loans. See our loan services.
Display the certificate at the premises, keep employee records such as appointment letters, ID cards, attendance and wage records, and keep the details on the portal current.
Changes and closure
| Event | What to do | Time limit |
|---|---|---|
| Change of address, name, employer or nature of business | Amendment online | Within 7 days |
| Workforce rises to 20 or more | Move from intimation to registration | Promptly, within one month of becoming covered |
| Change of constitution (proprietorship to partnership or company) | Usually a fresh registration in the new entity’s name | On commencement by the new entity |
| Closure of business | Online closure notice; registration cancelled | Within 30 days |
Records and display rules to follow after registration
Registration or intimation is only the first step. The amended Act also expects day-to-day compliance at the premises:
| Requirement | What it means in practice |
|---|---|
| Display of certificate or BIP ID | Keep it at a visible place in the shop or office |
| Appointment letters | Issue a letter with the employee’s photograph and prescribed particulars |
| Identity cards | Issue ID cards to employees with prescribed details |
| Working hours | Daily hours within the permitted limit and weekly total within 48 hours |
| Rest interval and weekly off | Follow the rest interval and weekly holiday rules |
| Overtime | Within the quarterly limit, paid at twice the ordinary rate |
| Wage and attendance records | Maintain and produce them during inspection |
| Online updates | Keep the portal details current |
Small businesses often miss appointment letters and ID cards because they were not common earlier. We share simple formats you can use for your staff.
Practical points for new businesses
- Register in the correct name. The name should match your PAN, GST and bank records, otherwise banks may reject the certificate as business proof.
- Count workers correctly. Include everyone working at the premises in the way the Act counts them. Crossing 20 workers changes your obligation.
- One premises, one record. Each separate shop or office location needs its own registration or intimation.
- Keep the BIP ID safe. It is needed for changes, closure and future references.

Frequently asked questions
Which law governs shops and offices in Gurugram?
The Punjab Shops and Commercial Establishments Act, 1958, as applicable to Haryana, now titled the Haryana Shops and Commercial Establishments Act, 1958. It was amended by the Haryana Shops and Commercial Establishments (Amendment) Act, 2025, which is deemed effective from 12 November 2025.
Do I need registration if I have fewer than 20 workers?
After the 2025 amendment, establishments with fewer than 20 workers do not need a registration certificate. They must file an online intimation on commencement of business, which generates a Basic Information Performa (BIP) ID. Establishments with 20 or more workers must register online.
How soon must I register after starting business?
An establishment with 20 or more workers must apply for registration within one month of commencing business. Smaller establishments should file their intimation when they start. Starting the process before you open is the safest course.
Is renewal of the Shop Act certificate required in Haryana?
No periodic renewal is required under the amended law. The registration remains valid until it is cancelled, for example on closure. You must, however, report changes in particulars and closure within the prescribed time.
Will a bank accept the BIP intimation for a current account?
Many banks accept the Haryana shop and establishment certificate or intimation as one of the proofs of business for a proprietorship current account, along with a GST certificate or Udyam certificate. Each bank has its own list, so we suggest checking with your branch. We can arrange two business proofs together if needed.
What documents are needed?
PAN and Aadhaar of the employer, a photograph, proof of the business address, the business name and nature of business, number of workers, and constitution documents such as a partnership deed or incorporation certificate where relevant. The application also captures a GPS-based location of the premises.
What if I change my address or the number of workers?
Changes in the particulars of a registered establishment must be reported within 7 days of the change, and the certificate is amended online. If your workforce grows to 20 or more, you move from intimation to registration.
What happens when I close my shop?
Closure must be notified within 30 days, after which the registration is cancelled. Keeping an old registration open can create confusion in later inspections or bank KYC, so we file the closure for you.
Kya home office ke liye bhi Shop Act lagta hai?
Agar aap ghar se commercial activity chala rahe hain aur workers hain, toh establishment ki intimation ya registration lag sakta hai. We look at your actual set-up and tell you whether the Act applies.
What are the penalties for not complying?
The 2025 amendment revised penalties. For general non-compliance the fine ranges from Rs 3,000 to Rs 10,000 for a first contravention and Rs 5,000 to Rs 25,000 for a repeat, with an additional amount for each day the contravention continues.
