When is CLU needed?

Large parts of Gurugram district outside sector development and approved estates are declared controlled areas, and land along scheduled roads is also regulated. On such land, use for anything other than agriculture needs permission from the Department of Town and Country Planning (DTCP), Haryana.

Proposed use Usually needs CLU?
Factory or industrial unit on private land in a controlled area Yes
Warehouse or cold storage Yes
Petrol pump, hotel, banquet hall, dhaba Yes
School, college, hospital, institutional building Yes
Commercial building or showroom Yes
Plot in an HSIIDC industrial estate (for example IMT Manesar) Generally no; HSIIDC approvals apply
Plot in a licensed colony or sector with approved layout Generally no; building plan approval applies
Continued agricultural use No

The answer depends on the development plan of the area and the zone in which your land falls. We first check the published development plan with your consultant.

Law or instrument Role
Haryana Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (originally the Punjab Act) Permission for change of land use and building in controlled areas and along scheduled roads
Haryana Development and Regulation of Urban Areas Act, 1975 Licences for colonies and related development
Published development plans for Gurugram, Manesar, Sohna and other towns Zoning, permitted uses and conforming zones
Amendment to Section 8 of the 1963 Act (2025) Self-certification for industrial use in conforming zones
DTCP policies and fee schedules Procedure, conditions and charges

Policies and schedules are revised from time to time. We go by the version in force on the DTCP website when the application is made.

Documents usually required

  • Ownership documents such as sale deed, mutation (intkal) and jamabandi.
  • Shajra plan and survey plan of the site prepared to the required scale.
  • Site plan and proposed land utilisation or layout plan from your architect.
  • Project report describing the use, built-up area and activity.
  • Genuineness or ownership-related affidavits and undertakings as specified.
  • Approach road details and any access permission required from the road-owning agency.
  • NOCs already obtained, for example from the Haryana State Pollution Control Board, forest or other departments where the site requires them.
  • Entity documents and authorisation if the applicant is a company, LLP or firm.

The exact list depends on the use and the zone, and DTCP publishes guidance for applicants. We prepare a site-specific checklist before filing.

Typical stages of a CLU application

  1. Feasibility. Check the zone in the development plan, road access, and whether self-certification may apply for industrial use.
  2. Document preparation. Title documents, plans and reports are collected and checked for consistency of khasra numbers, area and ownership.
  3. Online application. The application is filed on the DTCP Haryana online services portal and the applicable fees are paid as per the DTCP schedule.
  4. Scrutiny and site inspection. The District Town Planner’s office examines the documents and inspects the site, then reports through the circle office.
  5. Decision. The Directorate grants permission, with conditions, or communicates objections to be met.
  6. Compliance. Conditions in the CLU letter, such as building plan approval, payment of charges and completion within the permitted time, are tracked.

Fees and charges

All fees and charges are payable as per the DTCP schedule in force at the time of application. Common heads include a scrutiny fee, conversion charges and, in some cases, development charges. The amount depends on zone, land use, potential of the area and plot size. We list the heads that apply to your site after the feasibility stage.

Common reasons CLU applications get stuck

  • Title gaps. Mutation not updated, joint ownership without consent of all co-owners, or khasra numbers differing between the sale deed and revenue records.
  • Zone mismatch. The proposed use is not permitted in the zone shown in the development plan.
  • Access problems. Inadequate approach road width or no permission for access from a national or state highway.
  • Incomplete plans. Survey or layout plan not to the required scale or not matching the site.
  • Pending NOCs. Sites near forest areas, protected zones or other restrictions need clearances that take time.
  • Delayed replies. Objections raised by the department not answered completely.

Checking these at the feasibility stage, before the fee is paid, saves the most time and money.

Points to check before buying land for a project

If you plan to buy land near Gurugram for an industrial or commercial project, do the following before paying the full price:

Check Why
Zone in the published development plan Decides whether the use is allowed at all
Title chain and mutation CLU is filed on clean title
Road access and width Many uses have minimum access requirements
Existing CLU or licence on the land An earlier permission may have conditions or may have lapsed
Restrictions such as forest or protected areas Can block or delay permission

Frequently asked questions

What is CLU permission?

Change of Land Use permission allows land in a controlled area or along a scheduled road to be used for a purpose other than agriculture, such as industrial, commercial, institutional or warehousing use. It is granted by the Department of Town and Country Planning, Haryana.

Which law governs CLU in Haryana?

The main law is the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963, as applicable to Haryana, now cited in Haryana as the Haryana Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963. Licences for colonies are governed by the Haryana Development and Regulation of Urban Areas Act, 1975.

What changed in 2025?

An amendment to Section 8 of the 1963 Act, deemed effective from 13 November 2025, allows permission for industrial use in a conforming zone of a published development plan to be granted through self-certification online, as specified by the Director. Whether your site qualifies depends on its zone, so we check this first.

Is CLU needed for a plot in IMT Manesar or an HSIIDC estate?

Generally not, because land in HSIIDC industrial estates is already planned for industrial use and building plans are approved by HSIIDC. CLU is mainly needed for privately held land in controlled areas outside such estates.

What are the fees for CLU?

Fees and charges, such as scrutiny fee, conversion charges and development charges where applicable, are payable as per the DTCP schedule in force. They vary by zone, land use and area. We give you the applicable heads after looking at the site details, without guessing figures.

How long does CLU take?

It depends on the zone, completeness of documents, the site inspection and any NOCs needed from other departments. The Haryana government has set time-bound service delivery, but timelines vary, so we do not commit to a fixed date.

Kya CLU ke bina building plan approve ho sakta hai?

Nahi, if the land is agricultural and in a controlled area, building plans for non-agricultural use are generally approved only after CLU. Construction without permission can lead to sealing or demolition under the Act.

Does KSV prepare the drawings and survey plans?

No. Survey plans, site layouts and drawings are prepared by your licensed architect or surveyor, and title opinion comes from your legal adviser. KSV handles document collection, application filing, fee payment tracking and follow-up with the department, and coordinates with these professionals.

Can a CLU lapse?

Yes. CLU permission is project-specific and comes with conditions, such as completing construction or obtaining approvals within a set time. If conditions are not met, the permission can lapse or be withdrawn. Read the conditions in your CLU letter and track them.
